Key College Publishing Online Program
Terms of Use: August 2004

Titles included in the Key College Publishing Online Program are:

- Foundations of Diatonic Theory, by Johnson
- The Heart of Mathematics, Second Edition, by Burger and Starbird
- Interactive College Algebra, by Fischman, et al.
- Music and Computers, by Burk, et al.
- Workshop Precalculus, by Baxter Hastings
- Workshop Statistics: Discovery with Data, Second Edition, by Rossman and Chance
- Workshop Statistics: Discovery with Data and the Graphing Calculator, Second Edition, by Rossman, et al.
- Workshop Statistics: Discovery with Data and Minitab, Second Edition, by Rossman and Chance
- Workshop Statistics: Discovery with Data and Fathom, by Rossman, et al.
- Workshop Statistics: Discovery with Data, A Bayesian Approach by Albert and Rossman
Terms and Conditions of Use by Participating Schools and Instructors
- Participating School: A school is eligible to participate in the Key College Publishing Online Program (the Program) only if
- an Instructor at that institution has adopted a Key College Publishing textbook or course as the primary or required supplemental text for a class, and
- it is currently using the text or course in the class, and
- it has required students in the class to purchase or rent copies of the text, course or the Access Code Folder, and
- it agrees to participate in the Program at will and to release Key College Publishing (Key) from liability for technical, operational, and ethical problems that arise in the course of using the Program.
- Program Administrator: Each Participating Instructor must serve as his or her own designated Program Administrator for the online course or materials, and must
- determine whether these Terms and Conditions of Use violate any school or institutional policies and, providing they do not, certify that the school is eligible for the Program under the Terms and Conditions of Use
- register his or her class for the Program if this is a keycollege.com/online course (Interactive College Algebra; Music and Computers)
- agree on behalf of the Participating class and school to all of the Terms and Conditions of Use for Participating Instructors and cooperate with Key in verifying their status as legitimate faculty at the institution in question.
- agree not to post any access or validation code on the Web or post it publicly in any other way (such as in classrooms or in a school bulletin available to nonclass members), and not to distribute in any way the code to staff, to instructors not teaching with Key College Publishing texts or courses, students, or to others at the school site
- use reasonable efforts to ensure substantial compliance by Participating Instructors and Participating Students with their Terms and Conditions of Use
- report problems and misuse of access privileges to Key via the “Help” link on the school registration Web page so that Key may assist in resolving such problems
- act as problem-solver for Participating Students with respect to the school’s participation in the Program
- Term of Participation: Participation in the Program is granted on a semester-by-semester basis, and eligibility must be certified and registration renewed annually. Key reserves the right to change system eligibility, delivery, or platform for the Program registration at any time without notice.

- Verification of School Eligibility: Participation in the Program is subject to verification of eligibility by Key. Key may require verification prior to issuing an Instructor Validation Code (IVC) to a participating instructor or school. The Instructor agrees to assist Key in verifying school/course eligibility, and their own faculty status at the institution.
- Participating Instructors: An Instructor in a Participating School is eligible to participate in the Program if he or she
- has adopted a Key College Publishing textbook or course as the primary or required supplemental text for a class, and
- registers his or her class for the Program if this is a keycollege.com/online course (Interactive College Algebra; Computers and Music)
- agrees to the Terms and Conditions of Use by Participating Instructors
- Participating Instructors agree to advise Participating Students of the Terms and Conditions of Use by Participating Students and use reasonable efforts to enforce them.
- Participating Students: Students enrolled in a Participating Class will be issued a unique access code for their online textbook by purchasing a Key College Publishing textbook or Access Code Folder through their school bookstore or directly from the publisher. Students are subject to the Terms and Conditions of Use by Participating Students.
- Access is granted to the parents, guardians, mentors, tutors, and others personally assisting a Participating Student with his or her studies, but only for the purpose of personally assisting the Participating Student.
- Cancellation of Access: Failure of the Participating Instructor or Participating Student to substantially comply with the Terms and Conditions of Use, as determined solely by Key, may result in revocation of the student’s, instructor’s, or school’s registration in the Program and in cancellation of the access to online textbooks granted to the school, its individual instructors, and its students. In this case, no refunds are due any participants.
- Key does not guarantee access from all computers or with all browsers. Program performance varies with the speed of individual computers and the speed of the Web connectivity. Key makes no warranties as to Program performance or its compatibility with the computer hardware, networking software, or connectivity software of a school, its individual instructors, or its students. Participating Schools and Instructors agree to accept the technology “as is.”
- Due to rendering of printed course materials, portions of textbooks or other resources into Web-compatible languages for the online courses and materials, minor discrepancies may exist between the versions. Key reserves the right to make corrections in the online course materials periodically without notice, and to revise the functionality of the Program and these Terms and Conditions of Use at any time, without notice.
- Program Administrators and Participating Instructors are automatically enrolled in Key College Publishing Online’s Instructor Network and receive at most two email bulletins per semester about the Program, new products, professional development opportunities related to the Program, and important update information regarding the Key College Publishing Online Program.
- Any course, resources, or other materials contained within a Key College Publishing Online course are copyrighted. Participating Instructors may print pages from their online course materials for their own use, but may not copy the text, illustrations, course materials, or other files from the Web to a personal computer, email any such files to others, or distribute printed copies of the online course materials to others who are not Participating Instructors or Participating Students.
- If these Terms and Conditions of Use violate any school or institutional policies, the Program Administrator/Instructor agrees not to register the school for the Program.
Terms and Conditions of Use by Participating Students
Your one-time-use Access Code, permanent user name and password, and the access to the online course or course materials that it gives you is for your exclusive use. Your school and your Instructor have agreed to use reasonable efforts to enforce these rules:
- You are permitted to use your Access Code and permanent user name and password
- if your class currently uses any Key College Publishing Online course as the primary text or required supplemental text for the course, and
- if you have been issued or if you have purchased a copy of it (either in a new book purchase or via an Access Code Folder purchase).
- You may share your Access Code with a parent, guardian, mentor, or tutor who is helping you learn mathematics and who might need to look at your textbook.
- You are not permitted to give your Access Code to any student who is not enrolled in your course unless that student is personally assisting you in your studies.
- You agree not to post any access or validation code on the Web or post it publicly in any other way (such as in classrooms or in a school bulletin available to nonclass members), and not to distribute in any way the code to staff, to instructors not teaching with Key College Publishing texts or courses, students, or to others at the school site
